5. PROFESSIONAL BOUNDARIES AND CERTIFICATIONS
I have undergone intensive certified training which allows me to guide you through various breathwork practices. My training includes trauma-informed approaches, allowing me to guide participants with sensitivity to potential trauma. However, I am not a psychologist, medical doctor, or licensed healthcare professional. I do not diagnose medical or psychological conditions, provide medical treatment, prescribe substances, offer counselling, or interfere with treatment provided by licensed professionals. If you are experiencing psychological or medical conditions, please seek help from a qualified healthcare professional.

6. PERSONAL RESPONSIBILITY
You agree to take personal responsibility for your breathwork process. This practice is not a substitute for medical advice. The facilitator(s) cannot be held responsible for any mental, physical, or emotional challenges that may arise from this work. Unbound Flow takes no responsibility for any injuries sustained as a result of participating in these sessions. Unbound Flow's sessions are not intended to replace any relationship you have with your medical doctor and/or primary health care provider(s). The sessions are not intended to constitute medical advice or any substitution for medical care. The sessions are not intended to be relied on for prescriptions, recommendations, diagnosis, or treatment in relation to any health problem or disease. It is your responsibility to consult a health professional regarding any physical, mental, or emotional condition that could interfere with your judgment or affect your health during or after any session. You are responsible for consulting your health care provider or doctor in case you have or suspect you are suffering from a health problem. Your participation does not establish a client-practitioner relationship or any other type of therapeutic or professional relationship between you and the facilitator.
7. ASSUMPTION OF RISK
You understand that participating in breathwork and guided experience involved inherent risks, both known and unknown. These risks may include, but are not limited to:
Health risks associated with breathwork, including hyperventilation, breath holding, changes in blood pressure, and potential adverse reactions.
Hazard related to adventure tourism, such as falling rocks, uneven terrain, wildlife encounters, and unpredictable natural elements.
You acknowledge that you are voluntarily participating in these activities with knowledge of the potential risks involved, and you assume full responsibility for own safety and well-being. You agree to assume and accept full complete responsibility for any known and unknown risks associated with your participation in any session, including any physical injury, psychological or emotional effects, death, loss, or property damage.
You further acknowledge that any experience you are guided through with facilitators should not be attempted unsupervised on your own accord or without extensive experience, and in all circumstances, not near or in a body of water, in proximity to other hazards or without access to a suitable qualified healthcare professional.
8. RELEASE OF LIABILITY
In consideration for being permitted to participate in Unbound Flow breathwork and other guided experiences, you hereby waive, release, and discharge Unbound Flow, including its practitioners, officers, employees, and agents, from any and all claims, demands, actions, causes of action, liabilities, costs, and expenses, including attorney’s fees, arising from any loss, damage, injury, or death that may occur during or as a result of your participation. This release extends to your agents, assigns, executors, trustees, beneficiaries, heirs, or any other party.
You acknowledge that this waiver applies to all claims, whether known or unknown, anticipated or unanticipated, and releases Unbound Flow and its practitioners, officers, employees, and agents from any liability arising from participation in any and all sessions.
Please note that some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such states or jurisdictions, Unbound Flow's liability will be limited to the maximum extent permitted by law.
9. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Unbound Flow and subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
10. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
You understand and agree that you are not only giving up your right to sue Unbound Flow or any of its instructors and authorised personnel but also any rights your heirs, assigns, or beneficiaries may have to sue resulting in the unlikely occasion of your death.
11. PUBLICITY RELEASE
You agree that Unbound Flow may take photographs, videos or other media during the sessions and activities for promotional, marketing, or educational purposes without compensation or further consent.
You give your consent to Unbound Flow that photographs and recordings might be used on print and online, through website and social media platforms to promote Unbound Flow’s business and operations. You have the right to refuse your image being shared publicly at any stage, and agree to notify me of this decision.
You give your permission to use your likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, that you send to Unbound Flow and or to their social media.
12. DISCLAIMER OF WARRANTIES
I do not guarantee, represent or warrant that your use of my Service will be uninterrupted, timely, secure or error-free. I do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time I may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk. The stories or testimonials presented do not constitute a warranty, guarantee, or prediction regarding your experience. Unbound Flow makes no warranty, guarantee, or prediction about any particular state of awareness or consciousness during or after any session.
13. MODIFICATIONS TO THE SERVICE AND PRICES
Prices for my Service are subject to change without notice. I reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. I shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
